Objections and Suggestions for the Environmental Impact Assessment Draft 2020


Objections on EIA DRAFT 2020 

1. Post facto clearance : Any project can start its construction or start operating without taking any environmental clearance that is environment clearance can be taken later on. 

2. Public hearing is reduced to 20 days : Before making of any project the locals has a 20 days to assess the negative impact of that project on their surrounding. Earlier there was 30 days for it which is also very less. 


3. Exemptions from public participation : If a project violates an environmental law then public has no right to point out that violation. The violation can be revealed by the violater himself or the government. 

4. Strategic Exemptions: It is upto the government to decide what is strategic and what isn't. Public information regarding that would not be revealed by the government and no public hearing would be held. 

5. Additional Exemptions from public consultation: Border areas means area falling within 100 km aerial distance from the Line of Actual Control with bordering countries of India. This will impact North-East India especially, no public consultation would be done there.

Suggestions to EIA DRAFT 2020 

1. The clause of post facto clearance should be removed from the draft. Compulsory for every project to take Environmental clearance first then allow for construction or operations. 

2. The penalty price for environmental damage should be increased from 2k-10k per day (this amount is nothing for big companies whose daily profit is in lakhs). 

3. Do not distrub the ECOLOGICALLY SENSITIVE ZONES of the country such as Western ghat, North-East India. 


4. Consultant agencies that prepare EIA report should be held accountable. A proper committee should be established which include Environmentalist, Zoologist, Local NGOs to check the environmental damage of that project and safeguard the interest of Locals, Wild animals, Environment.

5. Only higly important strategic projects should be allowed in national parks and wildlife sanctuaries with proper rehabilitation of animals.
